Terms and conditions

Vila Pestera is run by SC Streaming Technology Innovation SRL. By making a reservation you agree to the terms below.

Who sells and invoices

Stays at Vila Pestera are sold, charged and invoiced by:

• STREAMING TECHNOLOGY INNOVATION S.R.L.

Online card payments (Visa, Mastercard) go through NETOPIA Payments or Stripe; your card details never reach us. The invoice is issued to the person or company making the reservation.

Check-in and check-out

• Check-in is from 14:00 on the day of arrival.
• Check-out is by 12:00 on the day of departure.

Reservations, cancellations and rescheduling

• Payments made for a reservation are not refunded.
• A reservation can be moved to other dates if you let us know at least 7 days before your arrival date, subject to availability.
• Rescheduling requests made less than 7 days before arrival cannot be accepted.

Your personal data

Your data is controlled by SC Streaming Technology Innovation SRL, CUI 44415425, J2023007335234, registered office Str. Nichita Stănescu nr. 72, Vila 15, Ap. 1, Mogoșoaia, Ilfov county, 077135, Romania (other details above). Write to reservations@villapestera.ro or call +40 739 890 467.

What we process, why, and on which legal basis:

• Name, phone, email and the messages you send on WhatsApp or by email: to answer you and make your booking (steps before a contract, and the contract, GDPR art. 6(1)(b)).
• A photo of your ID; your name, national ID number (CNP) or passport number, address: for the proforma and the invoice, and for the guest registration required by law (legal obligation, GDPR art. 6(1)(c); Romanian Accounting Law 82/1991; Law 190/2018 for the CNP).
• Booking details, payments and invoices: for the booking, payment and accounting (the contract and legal obligation).
• Your use of the smart home during your stay (opening the gate or key box, heating, charging an electric car: kWh, times, cost): for the services you ask for and to bill the charging (the contract).
• Images from the outdoor security cameras: for the safety of the property and of guests (legitimate interest, GDPR art. 6(1)(f)).
• Your answer to our question about offers, and unsubscribes: for special deals and news, only if you agreed (consent, GDPR art. 6(1)(a) and Romanian Law 506/2004) or, by email, if you have stayed with us (art. 12(2) of Law 506/2004).

Who receives your data

We never sell your data or share it with third parties for marketing purposes. Only the service providers we need to handle your booking receive it, under data processing agreements, and the authorities when the law requires it:

• Amazon Web Services (hosting and storage, in the EU);
• the provider that processes messages and documents automatically (OpenRouter, USA);
• Twilio and Meta (WhatsApp and SMS);
• NETOPIA Payments and Stripe (card payments; your card details never reach us);
• SmartBill and ANAF (invoices, e-Factura);
• Tuya and TTLock (the charger and key box controls; they don't receive your name).

Some providers are in the USA. Transfers rely on the EU–US Data Privacy Framework or the European Commission's standard contractual clauses.

How long we keep it

• Invoices and accounting records: 10 years, as Romanian Accounting Law 82/1991 requires.
• Everything else (messages, the photo of your ID, your use of the smart home): only as long as needed for the booking, the stay and our legal obligations; then we delete it.
• Camera images: a short time, only as long as needed for safety; then they are deleted automatically.
• Your yes or no to offers: as long as it stands, so we can respect it.

Security cameras

The cameras film only the outdoor areas of the property, never the inside of the villa. The entrances are signposted. During their stay, guests can see the cameras' live pictures on their Smart Guest Home page. Footage goes to the authorities only on a written request or to report an incident.

Offers and news

We send special deals and news about Vila Pestera only if you agreed (on WhatsApp we ask you once) or, by email, if you have stayed with us. You can unsubscribe at any time: reply STOP on WhatsApp or by email, or use the unsubscribe link in the email.

Your rights

You can ask for access, correction, deletion, restriction or portability of your data, object to its use, and withdraw your consent to offers at any time. Write to reservations@villapestera.ro; we answer within one month. You can complain to the Romanian data protection authority (ANSPDCP), www.dataprotection.ro.

Removing your data

If you would like your data removed from our database, write to us at reservations@villapestera.ro. We will handle your request within 5 business days.

Invoices already issued must be kept for the period required by accounting law; all your other data will be deleted.

Cookies

We only use strictly necessary cookies, for example to open your guest page. No advertising or analytics cookies.

Consumer protection and disputes

If you are not happy with our services, please write to us first at reservations@villapestera.ro; we answer within 5 working days and try to settle it amicably.

Romanian National Authority for Consumer Protection (ANPC): anpc.ro, Bd. Aviatorilor nr. 72, Sector 1, Bucharest.

Under Government Ordinance no. 38/2015 and ANPC Order no. 449/2022, consumers can use alternative dispute resolution (SAL): anpc.ro/ce-este-sal, and online dispute resolution (SOL): ec.europa.eu/consumers/odr.
